Even if you technically have the right-of-way as a car driver, you must yield to pedestrians who are in the road. You will always be at fault as the driver if you hit a pedestrian walking or riding a bicycle with your vehicle, regardless of whether the pedestrian had the right-of-way. x3.6 - Construction Workers Wisconsin Statute 346.27 The operator of a vehicle shall yield the right-of-way to persons engaged in maintenance or construction work on a highway whenever the operator is notified of their presence by flagmen or warning signs. Wisconsin Statute 346.18 This act requires persons convicted of violating statute 346.18 (Right-of-Way Rules) or a local ordinance, in addition to any other penalty provided by law, to attend a vehicle right-of-way course whose mode of instruction is approved and which is conducted by any regularly established safety organization, provider of driver education courses, or driver school. The course shall acquaint the person with vehicle right-of-way rules and provide instruction on motorcycle, pedestrian, and bicycle awareness. Failure-to-yield violations may include: failing to yield at an intersection, failing to yield when making a left turn, and failure to yield at a stop or yield sign.
